Terms and Conditions
Article 1: General Terms and Conditions of Sale
- By placing an order, the Buyer acknowledges having full knowledge of the following general terms and conditions of sale and accepts them in their entirety.
- All our sales are subject without exception to our general terms and conditions of sale, and any derogation or special condition requires our written agreement.
Article 2: Offer
- Cement tiles are entirely handmade with natural pigments. The number of operations on the tiles will result in variations and imperfections in the form of color nuances, surface halos, fine cracks, small air bubbles, scratches, and differences in thickness. These small imperfections are proof that everything is done in a traditional way and add to the overall charm once installed. The colors of our tiles may vary slightly, as may the graphics.
- All offers or price lists are non-binding on our part and may be modified without notice. Confirmed orders will be invoiced at the prices in effect on the date of delivery.
- Our delivery times are given as an indication and cannot give rise to late penalties or cancellation of the total or partial order.
- Any personalized design or mold remains the property of Suddart until the customer has not filed and registered intellectual or industrial property.
Article 3: Order Validation, Modification, or Cancellation:
- Suddart reserves the right to refuse any order without giving any reason.
- The terms of an order transmitted to the Seller are irrevocable with respect to the Buyer unless written acceptance from us. In this case, the seller is not required to respect the initially agreed deadline. In order to avoid processing fees and significant administrative costs, our goods will not be returned or exchanged.
- Any order placed by the customer becomes final only if it is not disputed or rejected in whole or in part by Suddart within 8 days of receipt. In the absence of dispute or total or partial refusal of the order within this period, the order will be deemed accepted and the sale will be concluded.
Article 4: Terms of Payment:
- A 50% advance payment is requested for any acceptance of the order on our part.
- Any order dedicated to export is in foreign currency and will be paid in full in advance by a bank transfer issued from abroad. All local invoices are payable before delivery in Tunisian dinars.
- The Buyer is prohibited from using any claim against Suddart as a reason to defer all or part of its payments.
Article 5: Delivery Terms:
- Suddart does not provide transport even if it uses third parties locally or internationally. The service remains the responsibility and responsibility of the buyer.
- The goods travel at the risk and peril of the customer. Suddart's responsibility stops at the exit of the factory.
- The unloading of goods is the responsibility of the customer. Receipt of the order results from the signature by the Buyer of the delivery note.
- The quantities of products delivered are subject to a tolerance margin of +/- 5% compared to the quantities ordered. The customer must check the goods upon receipt. The company is not responsible in case of loss.
Article 6: Storage and Installation
- Suddart cannot be held responsible for the mishandling and storage of tiles by the buyer. All cement tiles are packaged in cartons and must be stored away from the weather.
- Daily maintenance of the tiles is done with a non-aggressive product. It is strictly forbidden to use acid-based products because it is a natural material.
- The installation of the tiles and their finishing are under the full responsibility of the Buyer. Suddart cannot be held liable in case of non-compliance with the installation advice.
- Any defect related to improper preparation of the support causes damage to the tiles. Therefore, Suddart assumes no responsibility for the quality of the support as well as the quality of the installation and finishing and their consequences on the tiles.
Article 7: Claim
- Any claim for damage or non-conformity must be made to Suddart by e-mail within 7 days of the delivery date.
- No claim on the quantities delivered can be accepted after a period of 15 days from the date of signature of the delivery note.
- Suddart assumes no responsibility in the event that the customer does not respect the installation and maintenance advice.
- If the Buyer encounters a problem during installation or finishing, he can request technical assistance from Suddart which is subject to a previously established process: This involves sending a description and photos, Suddart makes the diagnosis internally and creates a claim, Suddart communicates to the buyer a list of recommendations to follow.
- The buyer must respect and imperatively apply Suddart's recommendations. In case of non-compliance with the recommendations after one month, the complaint will be closed and will no longer be Suddart's responsibility.
Article 8: Legal Jurisdiction
In case of dispute, jurisdiction is assigned to the courts of Bizerte.
